Waiver
In consideration of my participation and/or volunteerism (the term “participation and/or volunteerism” refers to but is not limited to, anyone who is issued and accepts this credential and/or ticket) in the Event and/or any pre- or post-race activities (collectively referred to as the “Event”) I, for myself, and on behalf of my spouse, children, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns (a) covenant not to sue, waive and release any and all rights, claims and causes of action I have or may have against any Event Organizer (as defined below) that may arise as a result of my involvement in the Event; and (b) except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties (as defined below) agree to indemnify, defend, and hold harmless all Event Organizers from and against any and all injuries, losses, demand(s), cause(s) of action, liabilities, damage(s), expenses (including attorney’s fees and court costs) or claims of any kind or nature (collectively, “Liabilities”) that might arise out of, result from, or relate in any way to my involvement in the Event and/or the condition of the raceway, property, facilities or equipment used for the Event, regardless of when such Liabilities may arise including, without limitation, Liabilities relating to (i) theft, loss or disappearance of property, (ii) bodily injury (including fatality); and (iii) property damage, for all claims and losses (including attorney’s fees and court costs), which may be brought against any one or more of them by anyone claiming to have been injured or otherwise to have suffered loss or damage as a result of my involvement in the Event. I further agree that if, despite this Waiver, I, or anyone on my behalf, makes a claim against any of the Released Parties, I will indemnify, defend and hold harmless each of the Released Parties from any such Liabilities which may be incurred as the result of such claim, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties, as relevant and applicable in each instance.
For these purposes, an “Event Organizer” and the “Released Parties” individually and/or collectively are any one or more of the following: Bank of America Corporation, Bank of America, N.A., and their subsidiaries and affiliates; Chicago Event Management, Inc.; Chicago Park District; City of Chicago; the facilities, venues and property owners or operators upon which the Event takes place; all governmental agencies representing the territory in which the Event will be held and from which resources (such as, without limitation, fire, police and ambulance personnel) are provided; all other organizers, promoters sponsors, advertisers, agents, coaches and officials for this Event, vendors, medical personnel, contractors and volunteers of or for the Event; USATF, its members, clubs, associations, sport disciplines and divisions; United States Olympic and Paralympic Committee (USOC); emergency (for example, fire and law enforcement agencies and other first responders) and all medical service providers and other public entities providing support for the Event; and the licensees, officers, directors, partners, members, employees, representatives, volunteers, agents, shareholders, successors and assigns of each of the foregoing. The Event sponsors and their affiliates have no control over Bank of America’s Event day operations or the acts or omissions of the Event owner, Bank of America.
I acknowledge that my participation and/or volunteerism may involve rigorous physical activity and that it potentially may be hazardous. I acknowledge that it is my responsibility to understand the risks associated with participating in the Event and determine the precautions I should take. I further acknowledge and agree that an inherent risk of exposure to infectious diseases is beyond the control of Event Organizers.
I further grant full permission to any and all Event Organizers to store, use, reproduce and/or resell my image or likeness by any audio and/or visual recording technique (including electronic/digital) now in existence or hereafter invented, for any legitimate purpose, including commercial sales and marketing purposes.
Reproduction and/or resale of this credential and/or ticket are prohibited.
Safety information
Event Alert System
The Event Alert System communicates the status of course conditions to participants, volunteers and spectators leading up to and on race day. All participants, volunteers and spectators should familiarize themselves with the Event Alert System color indicators, remain alert for directions from race officials, announcers, and volunteer leaders and take precautions to prepare properly for varying weather conditions on race day. Look for EAS communication in the start/finish areas, Grant Park, aid stations and via public announcements.
Public safety information
You can help maintain public safety in a few simple steps:
- Whatever your role on race day, be aware and check the area around you – observe runners, spectators, and general public. Be vigilant.
- If you are at an aid station, make sure that only your supplies are there and that no one has the opportunity to add to them or tamper with them.
- Keep a look out for bags or packages that appear to be unattended. If in doubt, ask!
- Do not store or hold bags or packages for someone you do not know.
- Report anything or anyone suspicious to your team leader or a police/security officer.
- Be good neighbors and respect the people and community around you; pick up after yourself and keep the noise to a minimum during early hours.
- Help keep the city and parks clean. Please use waste, recycle, and compost stations.
We work with the City of Chicago, Chicago Police Department, Chicago Fire Department and the Office of Emergency Management and Communications throughout all the stages of our planning process. These agencies work in tandem to ensure a safe and secure event.
